Photo Release
I hereby understand and acknowledge the participation of myself in a Leadership Long Beach program or event.
I grant Leadership Long Beach and those acting under its permission and on its authority, the right and permission to copyright, use, publish, display, produce, duplicate, sell and distribute photographic, video, or sound recording reproductions, portraits or pictures of me/my child and physical likeness, which may be included in whole, in part or in composite, for any art, advertising commerce, business trade, or any other lawful purpose.
I understand that this use applies to segments of the above for the public announcements, informational film clips, or other uses necessary to provide information or advertising for Leadership Long Beach.
I release, discharge, and agree to hold harmless Leadership Long Beach, its employees, Board of Directors, and those acting under its permission and on its authority from any liability to the extent permitted by law, for preparation, processing or distribution of the product.
Assumption of Risk, Liability Waiver, Release and Indemnity Agreement
In consideration of the acceptance of my participation in Leadership Long Beach's Discover Long Beach event, I agree and acknowledge the following:
- Assumption of Risk: My participation in the Leadership Long Beach event and use of the facilities involved therein is voluntary and is for my educational, recreational and social enjoyment. I recognize that use of the involved facilities and participation in the related activities involves risks, including the risk of serious personal injury, and I freely assume all risks, including unforeseen risks. Leadership Long Beach is not my insurer. I will maintain such insurance as I deem prudent to protect myself from all risks arising from this Agreement.
- Liability Waiver and Release: To the fullest extent permitted by law, I waive all claims, forever release and promise not to sue Leadership Long Beach, its employees, directors, officers, and volunteer leaders ("Leadership Long Beach") for any personal injury or property loss arising from use of the referenced facilities or participation in any organization-related activity by me, my family and guests, including any active or passive ordinary negligence of Leadership Long Beach.
- Indemnification: If any third party makes any claim or sues Leadership Long Beach because of any act or omission of myself, my family or guests, I promise to defend, hold harmless and indemnify Leadership Long Beach from and against any damage, liability, loss, cost, or expense including attorney fees, arising in connection with such claims or suit.
- Interpretation: As used herein, "Leadership Long Beach" shall mean Leadership Long Beach, its employees, directors, officers, volunteers, owners, affiliates and the partners, directors, officers, employees, agents and representatives of any of them. This Agreement contains all of the understanding between me and Leadership Long Beach regarding the subject matter hereof, and may be modified only in a writing signed by the party to be charged. The above release and indemnity provisions are intended to be as broad and inclusive as permitted by law. The provisions of this Agreement shall be interpreted in such a way so as to render them valid whenever possible, and any ambiguity shall not be strictly construed against Leadership Long Beach. If any part of this Agreement is held invalid by a court or arbitrator having jurisdiction, it shall be severed and the remainder shall continue in full force and effect.
